User License Agreement Covering Software Download

  • * In order to download and use the Software, you must first read and agree to be bound by the terms and conditions of the Software End User Licensing Agreement (Agreement) below.
  • * If, after carefully reading the Agreement, you agree to be bound by its terms and conditions, click the [I agree] button to advance to the download procedure.
  • * Regardless of whether or not you actually do agree, by downloading this Software, you indicate your agreement to be bound the terms and conditions of the Agreement and establish a contractual agreement between you and Casio Hitachi Mobile Communications Co., Ltd. (CHMC).
  • * If you do not agree with the terms and conditions of the Agreement, click [I do not agree] and do not download the Software.
Software End User Licensing Agreement

Casio Hitachi Mobile Communications Co., Ltd.

  1. 1. License
    The Software Programs, including this Software and the accompanying documentation ("Documentation"), are licensed, not sold, to you by Casio Hitachi Mobile Communications Co., Ltd.("CHMC") for use solely under the terms of this License Agreement. This non-exclusive license permits you to use this Software solely for the purpose of installing on your PC and connecting the PC with the hardware device, in order to update the same. Installing the Software onto a network server is a violation of this License Agreement.
  2. 2. Copying and Alteration
    You may not copy, alter, modify, adapt, translate, or create derivative works based upon the Software or Documentation or any part of them.
  3. 3. Transfer
    You may not sublicense, rent, lease, distribute, transmit, make available on a network or transfer the Software or Documentation to a third party.
  4. 4. Reverse Engineering
    You may not de-compile, reverse engineer, disassemble, or otherwise reduce the Software Programs to a human readable form.
  5. 5. Limitation of Liability
    CHMC will in no event be liable for indirect, special, consequential, or incidental damages resulting from any defect, error or omission in the Software or Documentation or from any other events including, but not limited to, any interruption of service, loss of business, loss of profits or good will, legal action or any other consequential damages. You assume all responsibility arising from the use of the Software and/or Documentation. CHMC's liability for damages to you or a third party will in no event exceed the total amount paid by you to obtain the rights to use the Software. THE SOFTWARE IS FURNISHED AS IS, WITHOUT WARRANTY OF MERCHANTABILITY OR FOR ANY PARTICULAR PURPOSE.
